Contracts Good Faith

The Faculty of Law, University of Windsor, is offering a two-hour CLE program on the recent Supreme Court of Canada’s decision in Bhasin v. Hrynew (November 2014), a decision that has affirmed good faith as an organizing principle of broad application in Canadian contract law, and which creates an affirmative duty of honest performance between contracting parties.

Five experts will present a program that will give you the most up to date guidance on what this development means for your commercial, employment and real estate practice.

 

Chris Waters will outline the details of Bhasin v. Hrynew and what and why the Supreme Court decided the way it did.

 

 

 

Claire Mummé will outline what the decision means in strengthening and expanding the doctrine of good faith performance in employment contracts.

 

 

 

Pascale Chapdelaine will explore how such a doctrine has been utilized in Quebec where it has been a part of the civil code for many years.

 

 

 

Troy Harris will discuss how a similarly imposed duty under the American Uniform Commercial Code and the Restatement (2nd) of Contracts has impacted contract law in that jurisdiction.

 

 

Jeff Berryman will explore some ramifications that flow from the decision in contract variation, conditions precedent, and remedies.
