The Force of the Better Argument in Legal Narratology

Abstract: The attention to narratives in legal contexts and the development of Legal Narratology has brought to light several issues of interest to argumentation theory scholars. We see here the importance of identifying types of narrative arguments and the ways in which they meet specific goals of different arguers in a case (lawyers, witnesses, judges, and victims). In spite of the call by several scholars for the development of means of evaluation for narrative arguments in legal contexts, that call has been largely unmet. This project examines the nature of narrative arguments in legal contexts, distinguishes types of narrative argument involved, and explores ways to evaluate the quality of those narrative arguments.
